Product terms and privacy drafts

The repository holds Spanish and English drafts of the terms of use and the privacy notice for the product. This page summarises what they say. They are drafts.

Draft, pending legal review

The repository marks both documents "DRAFT NOT REVIEWED BY A LAWYER". The Spanish text governs; the English is a courtesy translation. Nothing here is legal or accounting advice, and these are not the terms of any product, because none has been released.

What the terms draft says

  • A personal, non-exclusive, non-transferable licence of use. The program is not sold; rights stay with the owner.
  • Acquisition is free. A provisional flat fee might apply later only above a profit threshold; neither the threshold nor any price is decided; any change would be shown before it applies; you would never be blocked from your own data or from the version you installed.
  • Your business data is stored on your computer and is yours; you can export it in open formats and make backups.
  • Removing a module keeps its data by default; permanent deletion needs a verified backup and an acknowledgement.
  • Peruvian law may oblige you to keep books and receipts for years, so Simca does not let you delete tax data early. The retention table is a guide, not advice.
  • Simca gives no tax, accounting or legal advice and is provided as is, with liability limits that stay inside Peruvian law and never exclude wilful misconduct or consumer rights that cannot be waived.
  • Changes to the terms are shown before they apply and take effect only with your acceptance, recorded on your computer.

What the privacy draft says

  • The company does not receive your data, sales or books: no cloud, no telemetry.
  • The launcher's one opening request reveals a network address and time to whoever serves the manifest (see launcher updates).
  • Personal-data rights are handled on your computer; tax data is restricted rather than erased.

Still open

  • Review by a Peruvian lawyer, clause by clause.
  • The owner's identity and address and the complaints channel (the draft says to be defined).
  • Fee wording to be re-confirmed when the price table is filled.
