Data ownership
Retention and deletion for Peru
Peruvian rules can oblige a business to keep books and receipts for years. Simca is designed to refuse deleting them early, and to say so in Spanish.
Not legal or accounting advice
Not decided The repository says plainly that this is a reading of pages it fetched, that a Peruvian lawyer and an accountant must verify it before any customer relies on it, and that the retention table is draft, not reviewed. This site repeats none of the periods as a rule; check yours with your own advisers.
Built (repo) Parts exist as tested code (packaging, core, Logistics); Planned the rest, in the catalog's LEGAL module (57 items), is planned. None of it is in a product you can run.
How it is designed to work
- Archive by default. Removing a module keeps its data.
- Toss only non-tax data freely. Books, sales, tickets, stock and waybill tables declare a retention class; delivery and price lists deliberately do not.
- Retention clocks enforced in code. A signed, editable retention table gives periods and when each clock starts. A toss before the date is refused, not just warned about. Books wait for a recorded liquidation (which cannot be backdated) plus a further period.
- Legal hold. A hold blocks every toss until it is lifted with a typed confirmation, and both are audited.
- Export before delete and a verified backup first.
- Spanish acknowledgement. You type the element code after reading the Spanish text; the hash of the exact text shown goes into the audit. An English courtesy text exists.
- A tamper-evident local audit of every removal choice. It is sent to nobody.
- Personal-data requests that touch tax data are met by restricting the data, not erasing it (planned; reading to be confirmed by the lawyer).
Honest limits, as the repository states them
- There is no trusted time offline. Someone who sets the computer clock forward can pass a retention clock, and a stored high-water mark was rejected as false assurance.
- The audit is tamper-evident, not tamper-proof: someone who recomputes the whole chain can rewrite it.
- Backups outside Simca are yours to keep.
- The code enforces the table. Whether the table is right is a lawyer's job.
Still open
- Review of the periods, the clock start, the acknowledgement text, the terms and the privacy drafts by a Peruvian lawyer and accountant (D28).
- The personal-data request register, breach and loss guidance screens, the terms-acceptance record and an audit-head export (planned).
